Terms of Service

These Terms of Service ("Terms") govern your access to and use of Eduwand ("the Service", "we", "us"). By creating an account or using the Service, you agree to these Terms.

Provided as-is and not legal advice. Have your counsel review the final version before institutional deployment.

1. Eligibility & accounts

You must be at least 18 years old or have institutional authorization to use Eduwand as a teacher.
You are responsible for maintaining the confidentiality of your account credentials.
One person per account. Sharing a paid account is grounds for termination.
School and District plans require central admin authorization.

2. Subscription & billing

Free tier is provided at no cost with limits described on the pricing page.
Paid tiers are billed monthly or annually. Annual prepay is non-refundable past 14 days from charge.
Monthly subscriptions auto-renew until canceled.
Cancellations take effect at the end of the current billing period.
Free 14-day trial requires no card; converts only with explicit upgrade action.
Promo codes apply at checkout and may have eligibility restrictions (plan, expiry, single-use).
School/District invoices are issued via Stripe; Net-30 / Net-60 terms available on contract.

3. Acceptable use

You agree not to:

Use the Service for any unlawful, harmful, harassing, or fraudulent purpose.
Generate content that violates intellectual property, privacy, or anti-discrimination laws.
Attempt to reverse-engineer, scrape, or interfere with the Service.
Resell or sublicense Eduwand without a written agreement.
Use automated tools to bypass usage limits or rate limits.
Upload student personal data beyond what is necessary for legitimate educational use.

4. Content ownership

Your content stays yours. Lessons, homework, and assessments you create are owned by you (or your school/district). We claim a limited license only as necessary to operate the Service for you (storage, display, AI processing).

AI-generated content has uncertain copyright status under most jurisdictions; you are responsible for reviewing it before use with students.

5. Service availability

We aim for high availability but do not guarantee uninterrupted service on Free, Teacher Plus, or Teacher Pro tiers. School Premium and District plans include a 99.9% monthly uptime SLA.

We may temporarily suspend the Service for maintenance, security incidents, or to comply with law. Significant scheduled maintenance is announced at least 48 hours in advance.

6. AI provider terms

Eduwand routes lesson generation through Anthropic, OpenAI, and Google AI under their respective enterprise terms. Your input and the generated output are not used to train their general-purpose models. AI output is provided as-is and may contain errors — always review before using with students.

7. Termination

You may cancel any time from your settings. We may terminate or suspend your account for material breach of these Terms with a written notice (30 days) for cure where reasonable. Egregious violations (security abuse, fraud, harassment) may result in immediate termination.

Upon termination, your data is retained read-only for 90 days then permanently deleted. School/District data export requests must be made within this window.

8. Warranties & disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content is accurate, pedagogically optimal, or curriculum-aligned beyond reasonable effort.

9. Limitation of liability

To the maximum extent permitted by law, Eduwand's total liability for any claim arising from the Service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Governing law & disputes

These Terms are governed by the laws of the jurisdiction where Eduwand is incorporated. Disputes are resolved by binding arbitration in that jurisdiction, except for small claims and equitable relief.

11. Changes

Material changes to these Terms are announced by email 30 days in advance. Continued use after the effective date constitutes acceptance.
